FAQ

Property & Financial Affairs: lets your attorney manage bank accounts, bills, property, investments. Health & Welfare: lets your attorney make medical and care decisions. Most people want both, hence the LPA Double recommended. If you must really choose one: Property in priority (more used in practice).

Official Office of the Public Guardian timeline, outside our control. During this period, the LPA is not yet enforceable. Once registered, it remains valid for life (or until revocation). I track progress and notify you of official registration.

A third party who certifies that you understand the LPA and sign it freely. Can be: a doctor, a solicitor, a friend/acquaintance who has known you for more than 2 years (excluding close family). It's a mandatory step for OPG.

Yes. Attorney residence is not a legal criterion in the UK. Many of our clients choose a child in Paris or a sibling in Dakar as attorney. This can complicate practical execution in emergency (account access, physical presence), so we discuss during framing.

The UK LPA only covers UK assets and decisions. For France, you need a mandat de protection future or specific power of attorney. If you have assets in both countries, you need both arrangements. Dedicated blog post coming.

Critical points to understand before subscribing

1. The Certificate Provider is an INDEPENDENT third party. Not FrancoLegal. They certify that you understand the scope of your LPA and are not under undue influence. They must know you personally for at least 2 years, OR be a qualified professional (doctor, solicitor). If you don't have one, we can refer you to a professional partner (service at extra cost).

2. Attorneys residing outside the UK: our clientele being the diaspora, you may often wish to name a sibling or parent living in France or Africa. This is legally possible, but some UK financial institutions (notably banks) may refuse orders from attorneys residing abroad. We recommend having at least one UK-resident attorney for day-to-day management.

3. Mental capacity: essential at signing time. An LPA can only be signed by someone with full mental capacity. If you (or a loved one) have already lost this capacity, even partially, it is too late for an LPA — you must then go through the Court of Protection (long and costly procedure). OPG registration takes 8-10 weeks, and the LPA is only usable once registered.
